Terms of Service

These terms cover your use of OpenPermits: the website at openpermits.ai, the search app, alerts, exports and the API at api.openpermits.ai (together, the Service). OpenPermits is operated by HomeReceipt (“we”). By creating an account or using an API key you agree to them on behalf of the organization you sign up for (“you”).

1. What the Service is

We collect building permits, contractor licenses, parcel details and zoning decisions that governments publish, standardize them and make them searchable. The records come from public sources and are provided for business research, marketing and analysis. We don't verify each record with the issuing jurisdiction, and a source can be late, incomplete or wrong. Our coverage page shows which jurisdictions we cover and how complete each field is.

2. Accounts and teams

• You must give accurate account information and keep your password and two-factor device secure.
• Owners and admins control the organization's API keys, billing, webhooks and members, and are responsible for what members and keys do.
• API keys are credentials. Keep them on your servers, never in browser or mobile code, and revoke any key that may have leaked. Activity under your keys counts against your allowance.

3. Trials, plans and billing

• A trial lasts 14 days, needs a payment card, and includes 2,000 API credits and 500 export rows. Unless you cancel before it ends, your plan starts and your card is charged.
• Plans renew automatically each month or year until cancelled. You can cancel at any time from Plan & billing; access continues to the end of the period you have paid for.
• Fees are charged in advance through our payment processor (Stripe), exclude taxes unless stated, and are non-refundable except where the law requires otherwise.
• We may change prices for future periods with at least 30 days' notice by email.

4. Credits, exports and limits

The paid plan includes 50,000 API credits and 25,000 export rows a month. Credits are counted per record returned, as the API documentationdescribes, and reset monthly on your billing day. Unused credits don't roll over. Browsing in the app is included but rate-limited. When an allowance runs out, the API answers with HTTP 402 until it resets or your allowance changes.

5. Your license to the data

While your subscription is active, you may:

• use the data inside your organization for research, sales, marketing, underwriting support and analysis;
• show the data, or insights derived from it, to your own customers inside your products, in reasonable amounts and not as a bulk file;
• keep records you retrieved while subscribed, subject to the limits below.

You may not:

• resell, sublicense or redistribute the data as a dataset, feed or API, or use it to build a competing permit data service;
• share API keys or accounts outside your organization, or work around rate limits or allowances;
• use the Service in any way our Acceptable Use Policy forbids.

6. Not a consumer report

OpenPermits is not a consumer reporting agency and the Service is not a consumer report. You must not use it, in whole or in part, as a factor in deciding a person's eligibility for credit, insurance, employment, housing or any other purpose covered by the Fair Credit Reporting Act or similar laws. Property-level analysis (for example, the age of a roof at an address) is allowed; decisions about a specific person are not.

7. Personal information

We leave out the names of owners and applicants and residents' phone numbers, even where a source publishes them. Contractor business details stay, because they identify a licensed business. Our Privacy Policy explains what we collect about you as a customer.

8. Suspension and termination

We may suspend access, with notice where practical, if payment fails, if you breach these terms or the Acceptable Use Policy, or if your use puts the Service or others at risk. You may stop using the Service and cancel at any time. On termination your license to use data retrieved under these terms for new purposes ends; sections 6, 9, 10 and 11 continue to apply.

9. Disclaimers

The Service and the data are provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including accuracy, completeness, merchantability, fitness for a particular purpose and non-infringement. Check anything important with the issuing jurisdiction before relying on it.

10. Limitation of liability

To the extent the law allows, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Service is limited to the fees you paid us in the 12 months before the claim arose.

11. Indemnity

You will defend and indemnify us against third-party claims arising from your use of the data in breach of these terms, the Acceptable Use Policy or the law, including marketing and fair-lending laws.

12. Changes and the rest

We may update these terms; material changes take effect 30 days after we email account owners. These terms are governed by the laws of the State of Georgia, without regard to conflict-of-laws rules. If a provision is unenforceable the rest remains in effect. Questions: sales@openpermits.ai.
